TERMS AND CONDITIONS
These Terms and Conditions of Trading apply to all consumer contracts between Camerich UK Limited and our subcontractors ("us/we/our") and the Customer ("you/your") in relation to all sales of goods and services.
A. Free, No Obligation 365-day Trial Period / Sale Or Return
Our free 365-day trial period applies only to goods and services valued at under £20,000 including VAT and delivery. Goods are supplied on a try-before-you-buy basis until such time as the Trial Period expires or you opt to purchase the goods. Goods to be covered in Customer’s Own Material (COM) do not qualify. Your statutory rights are not affected. For any non-qualifying orders, or if you have opted out of the 365-day trial, our standard Returns and Refunds policy (clause 6) will apply. We reserve the right to withdraw the offer of a free Trial Period within 14 days of receipt of payment for any reason. If this occurs you will have the right to a refund of your security deposit without penalty.
Upon receipt of a security deposit payment, you will be eligible for our free 365-day trial period, with no obligation to buy. The security of your deposit is the possession of the goods. The free 365-day trial period will commence upon delivery of the goods and services. In the case of partial deliveries, the free 365-day trial period will commence when the first delivery takes place, and will expire 365 days after the final item has been delivered (therefore it will apply a total of 365 days after all goods and services have been delivered). This is not a hire purchase or conditional sale contract and you are under no obligation to purchase any products. You are however responsible for the goods whilst they are in your possession. The payment received from you will be considered a security deposit which will be refunded in full if you decide to return the goods to us in as-new condition within 365 days of receipt. If you do not return the goods once the trial period has elapsed, your deposit will be forfeited and a sale will be deemed to have taken place. The goods will then pass to your ownership. For the avoidance of doubt, ownership of the goods remains with us until the end of the trial period (or earlier if you opt out). If you do not wish to receive a free trial period please see clause C.
B. Returning goods during your 365-day Trial Period
In order to return the goods during the 365-day Trial Period, please email firstname.lastname@example.org informing us of your trial period SO- number and the items that you wish to return. We may then either request images of the products to be emailed to us, or arrange for a technician to visit to assess the items and provide a report. Goods will only be accepted for return in as-new and fully resaleable condition, the final decision of which will be made by Camerich UK Limited. If we wish to send a technician to assess the goods, you must make them available to be inspected on a number of different weekdays and times, and the inspection must take place within the 365 day trial period.
If it is agreed that the goods may be returned, you should arrange delivery of them by a suitable, insured carrier to our warehouse address (Units 6 & 7, Quadrant Park, Mundells, Herts AL7 1FS), clearly labelled with your name, the SO-number, number of packages and the product codes of the items. Goods that require disassembly must be returned with all fixings and parts in-tact and as-new. If you wish to use our preferred delivery and collection company, Atlas of London – 0800 028 6375 - you may obtain a quotation directly from them, and should pay any collection fees directly to them.
Once received and it is confirmed there has been no further damage between inspection and return, your refund will be processed within 30 days to the same card with which you paid, or to the same bank account in the case of cheque or BACS payments.
C. Opting Out of the free 365-day Trial Period
You do not have to benefit from a Trial Period – you can simply purchase without a trial period. To do this please ensure you tick “No” on your receipt next to “Free 365-day Trial Period”. In the case of telephone orders please inform us when making payment that you wish to opt out, and ensure that your emailed order confirmation has the “No” box on the Receipt ticked. If you decide at any time after receiving your receipt that you wish to opt out, please inform us via email at email@example.com stating your order number. Once you have opted out your security deposit payment will be forfeited and a sale will be deemed to have taken place. Our standard Returns and Refund policy (clause 6) will then apply.
D. Cover Swap
All of our upholstery items with removable covers (‘Applicable Items') are eligible for Cover Swap, a revolutionary new way for you to enjoy your furniture. A change of style needn't cost you a fortune - with Cover Swap we loan you the covers instead of you buying them, allowing you to return or replace them at any time. You can even choose a completely different fabric.
Half of the price stated on your receipt for any Applicable Item (marked with ‘~' on your Receipt) is the price to purchase the frame of that item. The other half is your security deposit, held by us for the safe return of your cover when you no longer need it.
If you wish to have a new set of covers, the only cost to pay would be a fee of 25% of the new cover price. This fee covers the collection and fitting.
If at any time you wish to return your covers you can do so for a refund of your security deposit, less reasonable deductions for loss or damage. The fee for collection of covers is 25% of the new cover price. The loaned covers are not available to purchase.

Frames and covers are sold separately: if you wish to opt out of Cover Swap and purchase instead please tick "no" on your Receipt or inform us via email at email@example.com stating your order number.
1. Product Specifications
1.1 We have a policy of continuous product development and reserve the right to amend the specification of products without prior notice in relation to future sales.
1.2 Goods supplied may differ from those on display or advertised. Unless agreed with you, the goods supplied will be of equivalent value, functionality and appearance. Any significant variations will be highlighted on the display model.
1.3 Leather goods are made from quality natural leather and accordingly they may not be uniform in colour or texture. Only the finest hides are selected but they will show natural marks and scars on the hide. Some leathers will mellow with age and exposure to sunlight and heat.
1.4 We will endeavour to match the colour and texture of the fabric of your sofa to the samples chosen as accurately as possible, but variations in both the colour and texture may occur. All fabrics will fade to some extent following exposure to sunlight and heat.
1.5 Some self-assembly may be required on certain products.
2.1 You must ensure that furniture ordered can be delivered into your property and that there is safe and reasonable access from the public highway to the place of delivery. Awkward access deliveries such as hoisting, removing window frames and doors are priced on request. Please call our delivery team (Atlas of London) on 0800 028 6375 for a quote. Atlas of London can arrange for an access check prior to delivery, but you will incur an additional charge for this service.
2.2 The measurements of all furniture and furnishings made by us will be as accurate as possible, but are nevertheless approximate.
3.1 All prices quoted include VAT or allowance for VAT, where appropriate, at the prevailing rate and are subject to any promotional offer or discount.
4.1 All orders, whether custom-made, currently in our warehouse or in transit must be paid for in full at the point of purchase. Only once we have received the balance of any monies due in cleared funds, will our logistics company be able to confirm your actual delivery date.
4.2 We will not commence manufacture, nor reserve stock items without payment in full.
5.1 Once your purchase has arrived to our UK warehouse, our logistics company will contact you within 48hrs to arrange delivery (exc. weekends). We must be able to deliver the furniture into your home within 6 weeks thereafter. If we are unable to do so due to your default, our logistics company will make a charge for storing the furniture beyond this point, which is payable in advance. They will advise you of this charge at the relevant time, or you may of course elect to receive delivery.
5.2 We will endeavour to offer next day delivery of stock items depending on delivery address and the availability of our delivery company. Stock orders can also be made available for collection within 24hrs. For next day delivery or collection orders must be placed before midday, and you should discuss with a member of staff at the point of purchase.
5.3 Standard delivery is to third-floor only (see Clause 5.4), includes assembly of the furniture and removal of packaging (which is taken away to be recycled). All deliveries are carried out by insured and qualified professionals. A two-to-three-hour delivery window is given as standard. Our delivery charges are as follows: Mainland UK - Free delivery for orders over £5,000; £59.00 for orders under £5,000; all other locations including worldwide delivery quotes are available upon request. £48.00 surcharge for a Saturday delivery; a £25.00 courier kerbside drop off service within M25 is available for small orders which can reasonably carried by one person; disposal of unwanted furniture is priced on request. We reserve the right to review and amend the aforementioned charges at any time.
5.4 If you are unable, for whatever reason, to take delivery of your goods on the confirmed delivery date, we reserve the right to charge you further for any subsequent deliveries.
5.5 You are responsible for providing a safe and reasonable means of access from the public highway to the place of delivery. If our delivery staff considers that access is unsafe, then we will not deliver the goods until safe access is provided. You are obliged to provide any required parking permits in advance.
5.6 If it becomes apparent during delivery that stock items you have ordered will not fit, you may return them (fully boxed) with the delivery team and receive a full refund less £59.00 (or the original cost of your delivery, whichever is the greater) to cover the aborted delivery and any re-stocking fees. Please note that if you request that the delivery team attempt to complete the delivery by removing the items from their packaging, you will be charged a restocking and handling charge (see clause 6.1)
5.7 Deliveries are undertaken by a third-party carrier and as such Camerich UK Limited can accept no liability for any damage to persons or property during the course of delivery or installation. Any claims or disputes regarding the delivery and installation of your goods must be dealt with via the third-party carrier directly.
5.8 Time of delivery is not of the essence in these Terms and Conditions of Trading. We will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of Camerich UK Limited or delay due to any reasonable rescheduling of delivery.
6. Returns and Refunds Policy (applicable to all orders that do not qualify or have opted out of the 365-day Free Trial Period).
6.1 If you have ordered a stock item and have not yet arranged for it to be delivered, then you may cancel and receive a full refund. If you have already arranged delivery of a stock item, you will be charged a cancellation or rearrangement fee of £59.00 if you cancel within 3 days prior to the arranged delivery date. This fee will be charged regardless of whether you wish to cancel the whole of your order or just the delivery itself. If you have ordered and received delivery of a stock item, you may return it within 14 days for a full refund less delivery charge, provided it is in fully saleable (as new) condition. If items you wish to return require disassembly and repackaging, a re-stocking and handling charge of 30% of the purchase price may be charged, or the original cost of delivery (whichever is the greater). If you wish to arrange your own return, this must be to our warehouse - not to the showroom, and we require prior notice of at least 48 hours. If it becomes apparent during delivery that stock items you have ordered will not fit, clause 5.6 will apply.
6.2 This Returns and Refunds Policy applies to stock items only – once an order has been placed in a custom size or fabric, it cannot be cancelled or returned. This does not affect your statutory rights.
7.1 The provisions of this clause 7 apply in addition to your statutory consumer rights in relation to faulty or mis-described goods. These rights are not affected by the guarantee.
7.2 All our upholstered furniture comes with a free 15-year frame only guarantee against faulty workmanship and/or faulty materials. The guarantee covers the frame only and does not cover fillings or coverings. All our non-upholstered furniture comes with a free 5-year guarantee against faulty workmanship and/or faulty materials.
7.3 Guarantees may not be transferred.
7.4 These guarantees do not cover fair wear and tear, neglect, abuse or misuse of your goods, loss or damage (including rusting and corrosion) due to unreasonable exposure to water, heat or weather; loss or damage due to fire, smoke, explosion, lightning, sunlight, infestation by animals or boring insects, or theft, or accidental damage or loss caused by a third party.
8. Claims Under Guarantee
8.1 In the event of a claim under guarantee occurring, please contact your nearest showroom and ask for the Showroom Manager, or e-mail us at firstname.lastname@example.org with the following information: - your sales invoice number, your address and contact details and a summary of the problem, including photographic evidence where appropriate.
8.2 We will endeavour to repair the defective goods free of charge. If a repair is not possible you will be offered a replacement and only if a suitable replacement is not available will you be offered a refund.
8.3 We will not be liable for any direct or indirect loss of profits or other financial loss or damage arising out of defective, damaged or wrongly delivered goods, over and above the value of the goods themselves. This does not affect your statutory rights.
8.4 Our guarantees are limited to goods sold and retained in the United Kingdom (including Northern Ireland), and used solely for private and domestic purposes.
9. Ex-Display and Clearance Items
9.1 You should thoroughly inspect any Ex-Display or Clearance Item prior to purchase. No refunds will be given. This does not affect your statutory rights.
10. Order Arrival Dates
10.1 Order arrival dates quoted are estimated only. For up to date expected arrival dates please contact your nearest showroom or use the order tracking function on our website.
10.2 Camerich UK Ltd will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any reasonable delay or delay due to unforeseen circumstances outside of the reasonable control of Camerich UK Limited or delay due to any reasonable rescheduling of delivery. This includes manufacturing delays, shipping delays and delays due to customs clearance. If you have a particular deadline please discuss this at the point of ordering with a Sales Representative. Delivery dates cannot be booked in until orders have arrived and been unloaded at our UK Warehouse and have been paid for in full.
11. Loan Sofas
11.1 Camerich UK Ltd cannot guarantee or the size, finish or style any loan sofa supplied, and reserve the right to supply a different loan sofa to that originally stated at point of order.
11.2 Loan sofas are not new products and may have some minor marks or signs of prior usage. Camerich UK Limited reserve the right to charge up to £45.00 per seat for cleaning of any loan sofa if it is discovered upon their return that they have deteriorated more than would be expected during the period of loan.
11.3 Loan sofas will only be delivered to the same address as the custom element of the order, and must be collected at the same time as the custom order is delivered.
11.4 Loan sofas remain the property of Camerich UK Limited throughout the loan period, and we reserve the right to collect them at any time after your custom order arrives to our warehouse.
12. Applicable Law
12.1 These Terms and Conditions of Trading are governed by and are to be construed in accordance with the laws of England and Wales.
